 City Council Wrap Up – June 12, 2023

The June 12 meeting began at 7 p.m. at Tucker’s City Hall with the Pledge of Allegiance led by members of Girl Scout Troop 14567. Afterward, Mayor Auman gave his opening remarks, proclaiming June 5-9 Municipal Court Clerks Week and recognizing the accomplishments of the City of Tucker’s Court Clerk staff. During a time of public comment, residents spoke both in favor of and in opposition to a proposed unlawful discrimination ordinance.

The Mayor and Council unanimously approved the agenda consisting of:

  • The minutes from May’s City Council Meetings
  • A resolution to amend the Adoption Agreement for the City’s Georgia Municipal Association 401(a) Defined Contribution Plan with a technical correction

The consent agenda also included several contracts:

  • Renewal of our GIS software license agreement with ESRI for $30,750
  • On-call road and stormwater maintenance with TriScapes, Inc.
  • MARTA bus pads and pedestrian connectivity with AF Concrete, Inc. for $97,150
  • Professional audit services with Nichols, Cauley, & Associates, LLC for $43,650
  • Addition of Pond & Company and Falcon Design to our list of on-call engineering services

Following the agenda’s approval, the Mayor and Council turned to the second reads of multiple ordinances. The first of these was an ordinance to amend Tucker Code Chapter 30 to adopt a new Article VIII Unlawful Discrimination. The public hearing consisted of 20 minutes each for speakers in support of and against the ordinance. Following the hearing, the Mayor and City Council approved the new ordinance 6-1.

The next item was an ordinance to set the 2023 millage rate at 1.5 mills higher than the rollback rate of .784 and included a brief public hearing. The proposed ordinance is scheduled for a third read and vote during a special called meeting at 6:45 p.m. on June 26.

Next was the second read of an ordinance to adopt a budget for the fiscal year 2024 which was approved unanimously. After this, the Mayor and Council approved the applicant’s request for a deferral of rezoning consideration at 2022 Brockett Road to June 26.

Community Development Director Courtney Smith then presented the second read of a text amendment to the City Code. This amendment, which includes minor changes to the zoning ordinance such as the title of Planning and Zoning Director, number of members on the Zoning Board of Appeals, board appointment terms and removal of inaccurate references, was approved unanimously.

An ordinance to bring City zoning code into compliance with new state law was approved following its second read and public hearing. The ordinance requires greater advance notice before certain public hearings.

The last read was the third and final for an ordinance amending the City charter to accommodate the results of the November 2022 referendum on public works and change the maximum number of days between regular meetings at which an ordinance can be read for the second time from 60 to 65 days to allow for greater flexibility. It was approved unanimously.

New business included contract consideration for engineering design of the Kelley H. Cofer Park Loop Trail. The contract was awarded to KAIZEN Collaborative for $143,400.

Next, the Mayor and City Council voted to approve a resolution to authorize the Tax Commissioner to continue to collect and remit special district revenues to the City to fund maintenance of existing traffic calming and street lighting districts inside the City limits.

Two first reads were held. The first of the two addresses a special land use permit for a massage establishment at 2110 Henderson Mill Road, Suite 22A. The second was for the adoption of the new Tucker Tomorrow Comprehensive Plan Update, and it is scheduled for a second read and public hearing on June 26.
