DRIVEWAY FAQs

Q: CAN I EXPAND MY DRIVEWAY?
A: A driveway can be expanded, as long as it is done in compliance with Tucker’s Zoning Ordinance in regards to lot coverage and materials.

Q: HOW BIG CAN THE EXPANSION BE?
A: The size will depend on two factors: total lot coverage and how much of the front yard is paved. Below is the maxi-mum lot coverage permitted in each residential zoning district. Additionally, only 35% of the area between the front façade of the home and the front property line can be paved. Lot coverage is the amount of impervious surface on the parcel including but not limited to the house, driveway, patios, accessory structures.

Q: I HAVE AN EXISTING GRAVEL DRIVEWAY. CAN I REPLACE THE GRAVEL?
A: Previously permitted gravel driveways can be maintained, but not expanded. Contact the Planning & Zoning Department at rmafe@tuckerga.gov before completing any work. Old gravel driveways that have not been continuously maintained are not permitted.

Q: CAN I USE PAVERS FOR THE EXPANSION INSTEAD OF A SOLID SURFACE?
A: Pavers are not a permitted material for a driveway. The driveway must be a continuously paved surface.

Q: CAN I ADD A SECOND DRIVEWAY AND CURB CUT?
A: The Land Development Code includes regulations on the number of curb cuts, spacing of curb cuts, and spacing of curb cuts from an intersection. A second driveway or additional curb cut will require review and approval by the City Engineer.

Q: DO I NEED A PERMIT TO EXPAND MY DRIVEWAY?
A:
Driveway expansions do not require a building permit, but residents should send a site plan and project description to the Planning & Zoning Department to ensure the standards referenced herein are met.

FENCE FAQs: NON-RESIDENTIAL

Q: HOW TALL CAN MY FENCE BE?
A: Fences shall be a maximum of ten (10) feet in height in a multifamily, nonresidential or mixed-use zoning district. The height of the fence is measured from the finished grade of the subject property. To determine the zoning of a property, please contact the Planning and Zoning Department at 678-597-9040.

Q: WHERE CAN MY FENCE BE LOCATED?
A:
We encourage property owners to put the fence just inside their property lines to avoid having to access another persons property to install or maintain the fence. Fences cannot be placed in the public right-of-way.

Q: WHAT MATERIALS ARE PERMITTED FOR MY FENCE?
A:
Brick, stone, wood, wrought iron, or aluminum that looks like wrought iron; vinyl coated chain link is permitted in the side interior or rear yard only. Uncoated chain link is not permitted. Wire fences are not permitted in the Mountain Industrial Boulevard Overlay.

Q: WHAT SIDE OF THE FENCE SHOULD BE FACING OUT?
A:
The finished side of the fence should face out; the unfinished side should face inwards toward your yard.

Q: DO I NEED A PERMIT TO INSTALL A FENCE?
A:
A permit is not needed to install a fence unless it requires footers (typical with brick or stone walls) or is over 8 feet in height. However, all fences must comply with the regulations referenced herein. Please submit a site plan, prior to installation of the fence, to the Planning and Zoning Department to ensure compliance with the regulations.

FENCE FAQs: RESIDENTIAL

Q: HOW TALL CAN MY FENCE BE?
A: The height of your fence will depend on whether you have a corner lot or not. The height of the fence is measured from the finished grade of the subject property.

Q: HOW BIG CAN MY SHED BE?

Q: WHERE CAN MY SHED BE LOCATED?
A:
Setbacks for a shed are different for corner lots and non‐corner lots. Please see the chart below:

Sheds cannot be located within a transitional buffer, stream buffer, or easement. Please contact the Planning & Zoning Department at 678‐597‐9040 to verify placement if you have concerns.

Q: WHAT MATERIALS ARE PERMITTED FOR MY SHED?
A:
Sheds greater than 200 square feet in floor area should be constructed out of a material similar to the principal structure. All shed materials shall comply with the permitted building materials listed in Section 46‐1416 of the Zoning Ordinance.

Q: DO I NEED A PERMIT TO INSTALL A SHED?
A:
Only sheds over 200 square feet require a building permit.

Q: MY SHED WILL BE OVER 200 SQUARE FEET. HOW DO I APPLY FOR A BUILDING PERMIT?
A:
The residential building permit application can be found at www.tuckerga.gov. Please submit the building permit application, building plans, elevations, and a site plan to permits@tuckerga.gov and it will be routed for review.

PERMANENT SIGNS FAQs

Q: I AM PLANNING TO OPEN A BUSINESS IN TUCKER. WHAT TYPE OF SIGN CAN I INSTALL? HOW BIG CAN MY SIGN BE?
A:
The City of Tucker allows several types of signs, including wall signs, projecting signs, canopy signs, awning signs, sandwich boards, entrance signs, directional signs, monument signs, and double post signs. The maximum size of the sign will depend on several factors including the zoning district of the parcel and the size of the façade. The City of Tucker Sign Code, Chapter 34, outlines regulations for each type of sign.

Q: THERE IS AN EXISTING GROUND SIGN AT THE LOCATION OF MY BUSINESS, CAN I USE IT?
A:
A legally nonconforming sign is one that does not meet the current code as it relates to the location of the sign, type of sign, for example. It is not permitted to structurally change a nonconforming sign, or to update it with changes to the size, shape, or technology. If a ground sign has gone unused for 6 months or more, it is considered abandoned and must be removed from the site. Refer to the full text on nonconforming signs in Section 34-71.

Q: CAN I PLACE SIGNAGE ON MY STOREFRONT?
A:
Yes, window signs or decals are allowed so long as they do not exceed 30 percent of the area of the individual window they are located on. This type of sign does not need a permit, but is required to comply with the code.

Q: WHERE CAN I INSTALL A GROUND SIGN?
A:
All signs must be located on private property and cannot be located in the public right-of-way. Permanent ground signs shall be setback 5’ from the property line.

Q: MY BUSINESS IS IN A SPECIAL ZONING DISTRICT. ARE THERE ADDITIONAL STANDARDS?
A:
Yes, there are additional regulations in the DT and NL zoning districts, as well as the Mountain Industrial Boulevard Overlay. Please see chapter 34 of the city code for the additional regulations.

Q: I WANT TO LET PEOPLE KNOW ABOUT A SPECIAL SALE OR EVENT MY BUSINESS IS HAVING. CAN I PUT UP A BANNER OR FEATHER FLAGS?
A:

Q: CAN I INSTALL LINEAR LIGHTING AT MY BUSINESS LOCATION?
A:
Linear lighting is prohibited in the City of Tucker.

TEMPORARY SIGNS FAQs

Q: I AM PLANNING TO OPEN A BUSINESS IN TUCKER. WHAT TYPE OF TEMPORARY SIGNAGE CAN I INSTALL TO LET PEOPLE KNOW ABOUT MY BUSINESS?
A:
The City of Tucker allows several types of temporary signs, including banners, special event signs, and other temporary signs such as construction signs. Special event signs include banners, metal, wood, pennants, flags, feather signs, balloons, or streamers.

Q: WHAT REGULTIONS DOES THE CITY HAVE FOR BANNERS?
A:
Banners are permitted in 14-day periods, with no more than 4 14-day periods allowed per calendar year. Banners may not exceed 32 square feet in area and must be maintained in good condition. They cannot be mounted on the roof, trees, or utility poles and they shall not extend more than five feet above grade when on the ground. Banners must be erected with supports or other means so that they do not sag.

Q: CAN I PUT UP FEATHER FLAGS?
A:
Feather flags are only permitted with a Special Event sign permit. They may only be up put up in conjunction with a special event, up to two times a year for a total of 16 consecutive days each.

Q: CAN I HAVE A SANDWICH BOARD SIGN OUTSIDE MY BUSINESS?
A:
Yes, these signs are allowed on private property and they must be removed and placed indoors at the end of each business day. Signs may not exceed 3’6” in height and 7 square feet in area. Plastic frames are not permitted. Only one sandwich board sign is allowed per establishment and they require a permanent sign permit.

Q: CAN I INSTALL LINEAR LIGHTING AT MY BUSINESS LOCATION?
A:
Linear lighting is prohibited in the City of Tucker.
