The City of Tucker Municipal Court is one of over 350 local courts within the Georgia Judicial System.

Tucker Municipal Court is an independent branch of government entrusted with the fair, timely and impartial processing of cases in accordance with local and state laws.  Tucker Municipal Court is committed to providing excellence, integrity, fair and efficient settlement of all cases.

Tucker Municipal Court has jurisdiction over violations of State Law and Local ordinances that occur within the city limits of Tucker. All persons are presumed to be innocent until proven guilty. Tucker Municipal Court conducts arraignments and non-jury trials for defendants that are charged with traffic citations and misdemeanors within the city limits of Tucker.

 At arraignments, defendants may enter a plea of guilty, nolo contendere, or not guilty. A plea of not guilty requires a non-jury trial or trial by jury to be heard where all evidence is presented, witnesses and officers are subpoenaed, and to prove guilt “beyond a reasonable doubt.”

Tucker Municipal Court will hear non-jury trials and all requests for a jury trial will be transferred to Dekalb County State Court. The courtroom entrance is on the right-hand side of City Hall. Tucker Municipal Court is open to the general public to observe all Court proceedings. 

Upon arrival, you will sign in. To ensure everyone’s safety, all individuals will go thru security, and all articles entering the courtroom are subject to search.

Proper Conduct During Court Proceedings

The courtroom is a place of order and structure. You should always act in a respectful manner when in the presence of the judge, court staff, attorneys, court officers and other persons attending court. Once the court has made a ruling in your case, continue to be respectful as you exit the courtroom. Attempts to disrupt the court once the judge has made a ruling will result in contempt of court which can result in a fine and/or jail time.

  2. Face mask and/or coverings are optional but strongly encouraged
  3. Everyone must go through security before entering the courtroom.
  4. No weapons (guns, knives, pepper spray, tools) allowed.
  5. Always maintain a safe distance
  6. Address the judge as “Your Honor”.
  7. All cell phones and other noise making devices must be turned off or set to vibrate.
  8. No food or drinks allowed or loud gum chewing.
  9. No hats, shorts, tank tops or halter tops allowed, and sunglasses must be removed.

Are Foreign Language Interpreters Available?

Interpreters can be provided for any court session. If you require translation for a language other than English, please inform the clerk’s office prior to the court date by calling (678) 597-9040 or email court@tuckerga.gov.

How Can I Plead?

You will be handed a Waiver of Rights Form in court and can plead Guilty, Not Guilty or Nolo Contendere (you do not contest charges).

What Additional Penalties Can Be Added To A Court Citation?

Late Payment Fee – $50.00 after 30 days of non-payment after judge’s ruling
Warrant Fee – $200.00
Admin/Technology Fee – $25.00 per citation
Contempt Fee  – $100.00
Failure to Appear Fee – $100.00

How Do I Pay A Fine?

Payments must be received by midnight the day before your court date or you must appear on the noted court date and time listed on your citation.  If multiple citations were issued, all citations must be settled in one transaction.  Once you miss your court date, you will no longer be able to pay online.

What Happens If I Do Not Appear In Court?

If you missed your court date, then the Judge will impose a failure to appear fee and possibly issue a bench warrant and/or license suspension. You will need to contact the court to discuss your options at 678-597-9040 or court@tuckerga.gov.

What Happens If I Am Late For Court?

Send an email to court@tuckerga.gov or call (678) 597-9040 and try to make it to court as soon as possible.

I Received A Citation From The City Of Tucker – What Do I Need To Do Now?

If your appearance in court is not required, then you can go online to tuckerpay.com or call 678-597-9040 and pay by midnight the day before your court date. If your appearance in court is mandatory, then you will need to appear on the date that is listed on the front of your citation.

How Do I Get My Own Attorney?

Court staff cannot provide legal advice.  Once you select an attorney, they must submit an Entry of Appearance to court@tuckerga.gov before your court date.

What Happens If I Can’t Afford An Attorney?

The judge may appoint a public defender at no charge if you qualify.

When May I Speak To The Solicitor About My Court Case?

Solicitors are available on court day.
